Terms and Conditions for purchases from RedRose Mobile Phones

1) Warranty

Rest easy. All products purchased on this web site are covered by a 12 month manufacturers warranty covering defective materials or defective workmanship from the date that they were delivered to you. The products may be repaired or replaced free of charge by the manufacturer. If you experience a fault or defect as a result of defective materials or workmanship, contact your nearest service centre as shown in the manufacturer's literature. You are of course welcome to contact RedRose Mobile Phones  as well to assist you at anytime.

2) Delivery

RedRose Mobile Phones will arrange delivery of the products by next day registered post, or recorded post, or by courier. For international orders a courier service will be used. Dates quoted for delivery are an approximation only, although we really do try to deliver on time! We will contact you if any delays are likely to occur. If goods cannot be delivered within 28 days we will contact you to arrange an agreement with you for when the goods will be delivered. All the costs associated with the delivery of the product(s) as quoted by RedRose Mobile Phones are to be paid by you with the price of the goods, unless a separate agreement has been reached. If we fail to deliver the goods for a reason that is not beyond our reasonable control and is not your fault, and we are liable to you, RedRose Mobile Phones's liability shall be limited to the excess (if any) of the cost to you of similar goods to those not delivered over the price of the products. Our aim is to keep you happy, so you will return to us and tell everyone about us.

3) Prices and Paying

Although we endevour to ensure that everything written about a product displayed in our on-line store is correct and up to date we cannot guarantee this. This includes prices. The prices are checked and updated as often as possible to remain competitive and to react to events beyond our control which can affect our pricing. Please ensure that you have checked all the details regarding the product and it's price just prior to placing your order, as they may have changed. You never know, the price could have gone down! If a price is changed between ordering and shipping, we will tell you as quickly as we can and let you decide whether you wish to cancel the order or continue at the corrected price. All products and services are of course subject to availability and we will advise you if a product or service is unavailable. The price of any product is the price quoted on RedRose Mobile Phones's web site at the time of your order. We do however reserve the right, giving notice to you anytime before delivery, to increase the price of products if there is an increase in our costs due to you, for example, requesting a different delivery date or address, a different quantity or a different product from the one specified (or the same product but with different specifications) in your order, or any delay caused by insufficient instructions or information given by you.

All prices are inclusive of VAT but are not inclusive of delivery. Orders from outside of the EU will not be charged VAT and prices are available on request if not displayed. Please call us. You will be responsible for any duties or taxes according to local laws if outside of the EU.

RedRose Mobile Phones  wants to make your buying experience as easy and efficient as possible, so we try to allow you to pay for services and products in the manner most suitable for you, without leaving ourselves open to unnecessary risk. For orders within the UK, we will accept payment by way cash deposit, bank transfer, cheque (after clearing into our bank account) or payment cards (Visa, Mastercard, Maestro, Switch, Solo, Delta). If paying by card it is important that your delivery address matches that of the card holder, at least until one or more orders have been placed and successfully completed. This is at our discretion. For orders outside of the UK we accept bank transfer, money order or bankers draft or Visa or Mastercard, other credit cards may be acceptable. If paying by credit card RedRose Mobile Phones will require a signed authorisation form and copies of the credit card by fax or post. Contact details can be found below, at the end of these Terms and Conditions. Whatever happens, RedRose Mobile Phones  requires receipt of cleared payment in pounds sterling, before arranging delivery of goods to you.Your credit or debit card will be debited once your order is ready for delivery, if the product is temporarily unavailable, your card will be debited when it is next available and ready to be shipped. We will contact you if there is any delay in this respect.

4) Ordering

Lets keep it simple. This website and all the information contained in it does not constitute an offer to contract or enter into an agreement. When you place an order for a product or service, we shall view it as an offer for the product or service chosen. Although we do not have to accept your order, we generally do! If we do accept it we will send you a confirmation of order email to the email address supplied by the customer. We can decline any order prior to it being shipped and we reserve that right. Once our confirmation message has been correctly sent to your electronic mail box on your Internet access provider's network, a contract or agreement for the products and/or services shall be formed. You must make sure your mailbox is working properly as you will assume the risk of all consequences for transmission or operational failures.

5) Risk of Damage or Loss

Risk of damage or loss of the product shall pass to you at the time of delivery. If you fail to take delivery of the products in a wrongful manner, the risk of damage or loss will pass to you from the time when RedRose Mobile Phones  has tended the products for delivery. Call us or email us if you have any questions on this matter.

6) Returns, Cancellations and Complaints

If you decide you don't want what RedRose Mobile Phones  has supplied you with, or you just plain don't like the thing, you have the right to give us a notice of cancellation within 7 days of the receipt by you of the goods; so long as: a) The packaging and all it's contents must remain in their brand new condition, so proper packaging will need to be used for postage return. b) any notice of cancellation must be given to us at the address set out below or by email to orders@redrosetrading.co.uk . c) The goods must reach us within 14 days of shipment out to you. d) If you cancel the contract you are required to return the goods to us (obviously!). Any software etc or protective packaging that has been opened or removed may incur a 20% fee. We cannot refund any shipping charges. Once you have cancelled the contract to both parties satisfaction, we will refund you the sum paid by you for the goods within 30 days. We just want to be sensible about the whole thing.

RedRose Mobile Phones isn't trying to get one over anyone, so if you're phone or product comes out of the box faulty, or develops a fault within a few days, just return it to us within 14 days from the date the goods were originally shipped out to you and we will send you a free replacement once we have verified the fault and the following is taken care of: we really do need the product back with all it's original packaging, documents and accessories etc and also a completed returns form and copy of the original receipt. Thank you.

If you have a complaint about RedRose Mobile Phones's service, please tell us in writing. You can email the director responsible for customer service on nickkirke@redrosetrading.co.uk. All complaints will be acknowledged as soon as possible (normally within 48 hours) and we will aim to resolve them within 14 working days.

7) A Privacy Statement

We want to and are committed to protecting your privacy. Any information we collect about you will be used lawfully and in accordance with the Data Protection Act 1998. You can check the information we hold about you by emailing us or writing to us at the address below. The personal information which we hold will be held securely. The only reason we collect personal information from you is to make your experience of using RedRose Mobile Phones  easier, safer and more efficient. If you have any questions about your privacy, please do not hesitate to contact us.

8) Definitions

In these Terms and Conditions:
'you' means the person whose order to purchase goods or services is accepted by us. 'we' or 'us' or 'our' means RedRose Mobile Phones . 'product' or 'products' or 'goods' or 'services' means the products or services we agree to supply within the terms and in accordance with these conditions. 'conditions' means everything written here!....in these Terms and Conditions of sale as well as any terms and conditions agreed in writing between you and us.

We, the Supplier, are RedRose Trading  (Company Number: 05351918) trading as RedRose Mobile Phones and our place of business and address for correspondence is Suite 3, 6 Nelson Gardens, Plymouth, Devon, United Kingdom PL1 5RH. You can contact us by ringing +44(0)1752 605916 from 9am to 5pm Monday to Friday. You may call outside of these hours but we cannot guarantee the lines will be manned. Any contracts or agreements formed between you and us through this website will be deemed to have been made in the UK and are based on, and will be governed by English law and any disputes/proceedings shall be subject to the exclusive jurisdiction of the English courts.
